In today's world, obtaining property in a foreign location is more accessible than ever. However, the process of real estate acquisition can be daunting, especially when purchasing in a foreign country. Here's some valuable information about acquiring property in South Africa.

The South African real estate market operates on a land registration system renowned for having one of the most efficient deed registration systems globally.

Any non-resident is entitled to purchase property in South Africa.

Real estate investments in South Africa can be held individually, jointly in undivided shares, or through entities such as companies registered outside South Africa.

All property acquisition contracts must be in writing, contain specific prescribed information, and be signed by both the buyer and seller to be valid and legally binding.

Upon acceptance, the offer to purchase transforms into a sales agreement. Once signed by both parties, this agreement becomes a legally binding contract, and neither party can withdraw without legal consequences. However, exceptions apply in cases where:

  • The agreement is subject to unmet conditions.
  • The purchase price is less than 250,000.00 rand, and additional criteria under the Alienation of Land Act are met.
